Deeds for Bonds CottagesTHIS INDENTURE made the Eleventh day of October One thousand eight hundred and ninety eight Between John Strouts formerly of Dully Farm Tonge in the County of Kent but now of Orsett House Rodmersham in the said County Farmer and Henry Payne of Sittingbourne in the said County Bank Manager of the first part Sarah Fuller the wife of Samuel Fuller of Lynsted in the said County Gentleman of the second part and the said Samuel Fuller of the third part Whereas Martha Stevens late of Bapchild in the said County Spinster deceased being then and thenceforth to the date of her death seised of the hereditaments hereinafter granted and conveyed for an estate in fee simple in possession free from incumbrances duly executed Will dated the Seventh Day of April One thousand eight hundred and ninety six and thereby after appointing the said John Strouts and Henry Payne Executors and Trustees thereof and after making certain pecuniary and specific bequests gave devised and bequeathed all her real and personal Estate of what nature and kind soever and wheresoever situate unto her said Trustees upon trust to sell and convert the same into money as soon as conveniently might be after her decease and to stand possessed of the proceeds of such sale and conversion upon trust as therein mentioned And whereas the said Martha Stevens died on the ninth day of March One thousand eight hundred and ninety eight without having revoked or altered her said Will and the same was duly proved in this Canterbury District Probate Register from the Twenty second day of April One thousand sight hundred and twenty eight by both the said Executors And whereas the said John Strouts and Henry Payne in execution of the aforesaid Trust for Sale have agreed to sell to the said Sarah Fuller the fee simple in possession of the said hereditaments free from incumbrances at the price of Four hundred and fifty pounds Now this Indenture Witnesseth that for effectualing the said sale and in consideration of the sum of Four hundred and fifty pounds this day paid by the said Sarah Fuller (out of moneys belonging to her for her separate use as the said Samuel Fuller doth hereby admit and acknowledge testified by his being a party to and executing these presents) to the said John Strouts and Henry Payne (the receipt of which said sum of Four hundred and fifty pounds the said John Strouts and Henry Payne hereby acknowledge ) They the said John Strouts and Henry Payne as Trustees Do and each of them Doth hereby grant and convey unto the said Sarah Fuller All those four messuages tenements or Cottages with the Carpenters' shop and other outbuildings and the gardens and ground held therewith and situate at or near Kingsdown Street and partly in the Parish of Lynsted aforesaid and partly in the Parish of Kingsdown in the said County of Kent and now in the occupation of Rye Smith Champion and Smith as weekly tenants thereof and containing in the whole One rood and twenty seven perches (by the same more or less) and as the whole of the same hereditaments and premises intended to be hereby granted and conveyed are more particularly delineated and described with their dimensions abuttals and boundaries in the map or place thereof drawn in the margin of these presents and thereon distinguished by a pink colour To hold the premises unto and To the use of the said Sarah Fuller in fee simple as her separate estate and property And the said John Strouts and Henry Payne retaining possession of the Statutory Declaration of Andrew Rye dated the nineteenth day of May One thousand eight hundred and ninety eight hereby acknowledge the right of the said Sarah Fuller to production of the same Statutory Declaration and to delivery of copies thereof In Witness whereof the said parties to these presents have herewith set their hands and seals the day

Bonds Cottages Deeds also HeathfieldTHIS INDENTURE made the 1st day of September One thousand nine hundred and twenty – Between Francis Albert Smith of Heathfield House Lynsted in the County of Kent Cabinet Maker (hereinafter referred to as the Borrower which expression shall be deemed his heirs executors administrators and assigns where the context so requires or admits) of the one part and Frances Amies of 44 London Road in the City of Canterbury Widow (hereinafter referred to as "the Lender" which expression shall be deemed to include her heirs executors administrators and assigns where the context is required or admits of the other part Witnesseth that in consideration of the sum of Four hundred and fifty pounds upon the execution of these presents paid by the Lender to the Borrower (the receipt of which said sum the Borrower hereby acknowledges) He the Borrower doth hereby covenant with the Lender to pay to her on the Sixth day of January One thousand nine hundred and twenty one the said sum of Four hundred and fifty pounds with interest for the same in the meantime at the rate of Eight pounds per centum per annum from the date of these presents and also so long December One thousand nine hundred and one and made between John Coare SwaineCecil Edward Kingsford and George Herbert Frend of the first part Frederick NeameWilliam Roper Dixon of the second part and George Gardiner of the third part and thereon coloured pink And Secondly All those your messuages tenements or cottages with the Carpenters' Shop and other outbuildings and the gardens and ground held therewith and situate at or near a place called Kingsdown Street partly in the Parish of Lynsted and partly in the Parish of Kingsdown in the said County of Kent and now in the occupation of weekly tenants and containing in the whole One rood and twenty seven perches (be the same more or less) and as the whole of the same hereditaments and premises are more particularly delineated and described in the plan thereof drawn in the margin of a certain Indenture of Conveyance dated the Eleventh day of October One thousand eight hundred and ninety eight and made between John Strouts and Henry Payne of the first part Sarah Fuller of the second part and Samuel Fuller of the third part and therein distinguished by a pink colour To hold all the said premises hereinbefore first and secondly described unto and To the use of the Lender in fee simple Subject to the proviso for redemption following namely that if the Borrower shall on the Sixth day of January One thousand nine hundred and twenty one pay to the Lender the sum of Four hundred and fifty pounds and interest thereon at the rate aforesaid then the Lender will at the request and cost of the Borrower reconvey the said premises to the Borrower And (in addition to the statutory covenants implied by law) the Borrower hereby covenants with the Sender that he the Borrower will on the occasion of making any deduction of Income Tax Schedule "A" from any interest money payable under these presents produce to the Lender the receipt or other Official Voucher proving that he has paid the said Tax to the Collector of Inland Revenue And also that he will during the continuance of this security keep every messuage and building for the time being comprised in this security in good and substantial repair and condition and will not pull down injure or remove any messuage or building or other property for the time being comprised in this security so as to lessen or depreciate the value of this security And that he the Borrower will so long as any money shall remain owing on this present security keep the said messuages and buildings insured against loss or damage by fire to the full value thereof (but not less than Nine hundred pounds) in such office for insurance as the Lender shall name and will pay all premiums and sums of money necessary for such purpose on the first day on which the same respectively ought to be paid and will deposit the policies with the Lender and will on demand produce to the Lender the receipt for every such premium And it is hereby declared that the monies to be received from any such policy shall as soon as practicable be applied in rebuilding or reinstating the buildings destroyed or damaged by fire Provided always and the Lender hereby agrees that if on every half yearly day hererinbefore fixed for payment of interest while any principal money remains due under these presents or within Twenty one days next after each such day there shall continuously be paid to the Lender interest on such principal money at the rate of Seven pounds per centum per annum and there shall not be any breach of any obligation statutory or otherwise binding on the Borrower or of any of the covenants whether express or implied herein contained and on the part of the Borrower to be observed or performed (other than and besides the covenant for payment of the principal money and interest hereby incurred) then the Lender will accept interest for the principal money so for the time being due at the rate of Seven pounds per centum per annum so long as interest at that rate continues to be paid within the Seventy one days aforesaid Provided always and it is hereby further agreed and declared that the Borrower shall not without first obtaining the consent in writing of the Lender exercise any of the powers of leasing and agreeing to lease or let conferred upon a Mortgager by Section 18 of The Conveyancing and Law of Property Act 1881 or by any statutory modification thereof for the time being in force but it shall not be necessary to express such consent in any such lease or agreement And it is hereby further agreed and declared that the powers of sale and appointing a Receiver conferred by Section 19 of the last mentioned Statute shall in addition to the cases in which under the Act they may be exerciseable be exerciseable immediately on the Borrower his assigns taking or being the object of proceedings in Bankruptcy or compounding with his creditors or (in case of his assigns being a Company) winding up voluntarily or compulsorily In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written

This Indenture made the twenty fifth day of September One thousand nine hundred and twenty three Between Frances Amies of 44 London Road in the City of Canterbury Widow of the first part - Francis Albert Smith of Heathfield House Lynsted in the County of Kent Cabinet Maker (hereinafter referred to as "the Borrower" which expression shall be deemed to include his heirs executors administrators and assigns where the context so requires or admits) of the second part and George Alfred Henry Smith of Berkeley House Lynsted in the County of Kent Fruit Farmer (hereinafter referred to as "the Lender" which expression shall be deemed to include his heirs executors administrators and assigns where the context so requires or admits) of the third part Supplemental to an Indenture (hereinafter referred to as "the Principal Indenture") bearing date the First day of September One thousand nine hundred and twenty and made between the Borrower of the one part and the said Frances Amies of the other part whereby the premises specified in the Schedule hereto were granted and conveyed by the Borrower unto and to the use of the said Frances Amies in fee simple by way of Mortgage for the purpose of securing payment to the said Frances Amies by the Borrower of the sum of Four hundred and fifty pounds together with interest thereon at the rate of Eight pounds per centum per annum reducible to Seven pounds per centum per annum on punctual payment Whereas the principal sum of Four hundred and fifty pounds still remains owing by the Borrower to the said Frances Amies upon the Security of the Principal Indenture but all interest on the said sum has been paid up to the date of these presents And whereas the Lender has at the request of the Borrower agreed to pay to the said Frances Amies the said sum of Four hundred and fifty pounds and also to lend to the Borrower the further sum of One hundred pounds upon having the payment of the said principal sum of Four hundred and fifty pounds and One hundred pounds making an aggregate principal sum of Five hundred and fifty pounds with interest at the rate hereinafter mentioned secured by a transfer of the said Mortgage debt of Four hundred and fifty pounds and interest and securities for the same and otherwise in manner hereinafter appearing Now this Indenture witnesseth as follows:-

1. In pursuance of the said Agreement and in consideration of the sum of Four hundred and fifty pounds now paid to the said Frances Amies at the request of the Borrower by the Lender (the receipt whereof the said Frances Amies doth hereby acknowledge) and in consideration of the sum of One hundred pounds now paid to the Borrower by the Lender (the receipt and payment in manner aforesaid of which said sums of Four hundred and fifty pounds and One hundred pounds making an aggregate sum of Five hundred and fifty pounds the Borrower doth hereby acknowledge) the said Frances Amies as Mortgagee at the request of the Borrower and hereby assign unto the lender All that the said principal sum of Four hundred and fifty pounds now owing to the said Frances Amies upon the security of the principal Indenture and all interest henceforth to become due for

the same and the benefit of the powers remedies and securities contained in or given by the principal Indenture for securing and recovering the said principal sum and Interest To hold the same unto the Lender absolutely To the intent and so that the Mortgage Debt of Four hundred and fifty pounds hereinbefore assigned may be kept on foot as a subsisting charge and for more effectually securing to the Lender the payment of the said sum of Five hundred and fifty pounds intended to be hereby secured and the interest thereon in accordance with the covenant in that behalf hereinafter contained.

2. In further pursuance of the said Agreement and for the consideration aforesaid the said Frances Amies as Mortgagee at the request of the Borrower hereby grants and conveys and the Borrower as Beneficial Owner hereby grants conveys and confirms unto the Lender All the hereditaments comprised in and subject to redemption by the principal Indenture being the hereditaments specified in the Schedule hereunder written To hold the same unto and To the use of the Lender in fee simple Free from all equity of redemption under or by virtue of the principal Indenture but subject to the Proviso for redemption hereinafter contained----------------

3. Provided always that if the Borrower shall on the Sixth day of January next pay to the Lender the sum of Five hundred and fifty pounds with interest thereon in the meantime at the rate of Five pounds per centum per annum the Lender shall at any time thereafter at the request and cost of the Borrower reconvey the premises hereinbefore granted and conveyed to the use of the Borrower in fee simple------------

4. The Borrower hereby covenants with the Lender to pay to the Lender on the said Sixth day of January next the said sum of Five hundred and fifty pounds with interest thereon in the meantime at the rate of Five pounds per centum per annum from the date of these presents and further of the said principal sum shall not be so paid to pay to the Lender interest at the rate aforesaid by equal half yearly payments on the Sixth day of January and the Sixth day of July in every year in the principal moneys for the time being remaining due on this security-------------------------------------------------

5. The powers and provisions contained in the principal Indenture shall operate and take effect in like manner for securing the said sum of Five hundred and fifty pounds and interest as if such powers and provisions were herein repeated with such alterations only as would be necessary in consequence of the substitution of the Lender for the said Frances Amies and in consequence of the change of the amount of the principal moneys secured

AND RECTG the sd Sarah Fuller had two sons only children of a former marriage with Henry Smith decd vicelike the sd George Alfred Henry Smith and Francis Albert Smith who on Her death became her only co-heirs According to the custom of gavelkind
AND RECTG Letters of Administration Of the estt of the sd decd were granted by By H.M. High Court of Justice out of Ppal Pbte Regy throf to the sd Samuel Fuller on 17th Jan 1906
AND RECTG the Parties thrto being the only persons Interested in the real estt of the sd Sarah Fuller decd had entered into a mutual Arrangement respecting the sd real estt Under wh the sd Francis Albert Smith Had become and was entitled in equity as his share and intt both in possen and Reversion of an in the real estt of the sd decd to the heredits thrinar granted and released or intended so to be and to the fee simple in possen throf free from incumbs except as such per rep as afsd was liable to pay and especially free from estt by the curtesy of the sd Samuel Fuller for which ample provision had been mde to the satisfaction of the sd Samuel Fuller as he thrby admitted

IT WAS WITNED that in pence of the sd mutual arrangmt and in conson of the premes and for the ppse of vesting in the sd Francis Albert Smith the entire esttin the sd heredits as afsd.
