and his Trustee]

This Indenture made the Twenty Fourth Day of December in the Thirty second year of the Reign of our Sovereign Lord George the Third By the grace of God of Great Britain France and Ireland King Defender of the Faith etc. And in the year of our Lord one Thousand seven Hundred and Ninety one Between Robert Wood heretofore of Cranbrooke in the County of Kent Victualler and now of Sittingbourne in the said County Baker of the one Part and Joseph Ashbee of Doddington in the said County Yeoman and Henry Coulter of Doddington aforesaid Yeoman (a Trustee named by and on the Behalf of the said Joseph Ashbee) of the other Part Witnesseth that for and in Consideration of the Sum of Eighty three Pounds of good and lawful Money of Great Britain to the said Robert Wood in Hand well and truly Paid by the said Joseph Ashbee at or before the Ensealing and Delivery of these Presents and of the Sum of ten Shillings of like lawful Money of Great Britain to the said Robert Wood in hand also at the same Time well and truly Paid by the said Henry Coulter the Receipt and Payment of which said two several sums of Eighty three Pounds and Ten Shillings accordingly and himself to be therewith fully Paid and satisfied He the said Robert Wood doth hereby confess and acknowledge and thereof and every Part and Parcel thereof doth acquit release and discharge the said Joseph Ashbee and Henry Coulter and each of them their and each of their Heirs Executors Administrators and Assigns and every of them for ever by these Presents He the said Robert Wood Hath granted bargained sold aliened remised released and confirmed and by these Presents Doth grant bargain sell alien remise release and confirm unto the said Joseph Ashbee and Henry Coulter (in their actual Possession now being by virtue of a Bargain and Sale to them thereof made by the said Robert Wood in Consideration of the Sum of Five Shillings for the Term of one whole Year by Indenture Bearing Date the Day next before the Day of the Date of these Presents and commencing from the Day next before the Day of the Date of the said Indenture of Bargain and Sale and by force of the Statute made for transferring Uses into Possession) and to the Heirs and Assigns of the said Joseph Ashbee for ever All that Messuage or Tenement with the Garden Orchard and Land thereunto belonging containing in the whole by Estimation one acre be the same more or less with the Appurtenances situate lying and being at or near a certain Place called Ellett Wood Gate in the Parish of Doddington in the said County of Kent late in the Tenure or Occupation of the Widow Sills her Assigns or Undertenants and now of …………………………………….Assigns or Undertenants Abutting Bounding to the Lands of Mrs. Ann Thornicroft towards the South and West and to the said Wood called Ellett Wood and to the Kings Highway there towards the North and East or otherwise howsoever the same doth abut bound or lye And all and all manner of Houses Outhouses Edifices Buildings Trees Ways Paths Passages Entries Ponds Wells Waters Watercourses Watering Places Commons Common of Pasture Hedges Hedgerows Ditches Mounds Fences Rents Rights Easements Privileges Profits Commodities Emoluments Advantages Hereditaments and Appurtenances whatsoever to the said Messuage or Tenement Garden Orchard Land and Premises aforesaid belonging or in any wise appertaining or therewith or with any Part or Parcel thereof now or at any Time or Times heretofore usually letten demised held used occupied or enjoyed or accepted reputed deemed taken or known as Part Parcel or Member thereof or any Part or Parcel thereof And the Reversion and Reversions Remainder and Remainders Yearly and other Rents Issues and Profits thereof and of every Part and Parcel thereof And also All the Estate Right Title Interest Use Trust Possession Inheritance Property Benefit Claim and Demand whatsoever both at Law and in Equity of him the said Robert Wood of in to or out of the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereinbefore granted released and conveyed or mentioned and intended so to be with the Appurtenances or of in to or out of any Part or Parcel thereof And all Deeds Evidences Escripts Muniments and Writings Whatsoever which concern or relate to the said Premises only or only any Part thereof now in the Hands Custody or Power of him the said Robert Wood or which he can come by without Suit at Law or in Equity To Have and to Hold the said Messuage or Tenement Garden Orchard Land Hereditaments and all and singular other the Premises hereby granted released and conveyed or meant mentioned and intended so to be with their and every of their Rights Members and Appurtenances unto the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee To and for the only Proper use and Behoof of the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee forever In Trust nevertheless as to the Estate and Interest of the said Henry Coulter of and in the said Premises to and for the only Proper Use and Behoof of the said Joseph Ashbee his Heirs and Assigns for ever and to be by him the said Henry Coulter from Time to Time conveyed and disposed of as the said Joseph Ashbee his Heirs or Assigns shall direct or appoint And the said Robert Wood for himself his Heirs Executors and Administrators doth covenant Promise and agree to and with the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee by these Presents in Manner and Form following (that is to say) that (for and notwithstanding any Act Deed Matter Cause or Thing whatsoever by him the said Robert Wood at any Time or Times heretofore had made done committed or wittingly or willingly suffered to the Contrary) He the said Robert Wood now at and immediately before the Time of the Ensealing and Delivery of these Presents is and standeth solely lawfully rightfully and absolutely sieded to him and his Heirs of a good sure Perfect Lawful absolute and indefeazible Estate of Inheritance in Fee simple in Possession of and in the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereby granted released and conveyed or meant mentioned and intended so to be with their Appurtenances without any manner of Condition Contingent Proviso Limitation of Use or Uses Trust Power of Revocation or any other Restraint Matter Cause or Thing whatsoever which can shall or may alter change charge revoke frustrate determine lessen incumber or make void the same Estate or the Uses thereof And also that he the said Robert Wood (for and notwithstanding any such Act Deed Matter Cause or Thing to the Contrary as aforesaid) now hath in himself and by himself good Right full Power true Title and lawful and absolute Authority to grant Bargain sell release and convey the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereby granted released and conveyed or mentioned and intended so to be within their Appurtenances unto and to the Use and Behoof of the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee in Manner and Form aforesaid and according to the Purport true Intent and Meaning of these Presents And also that it shall and may be lawful to and for the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee from Time to Time and at all Times hereafter lawfully Peaceably and Quietly to enter into have hold use occupye Possess and enjoy the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereby granted released and conveyed or mentioned and intended so to be and every Part and Parcel thereof with their Appurtenances and to receive and take the Rents Issues and Profits thereof and of every Part and Parcel thereof to and for his and their own Proper Use and Benefit without any lawful Let Suit Claim Trouble Denial Molestation Eviction Ejection Interruption or Disturbance whatsoever of or by the said Robert Wood or his Heirs or of or by any other Person or Persons lawfully Claiming or to Claim by from under or in Trust for him them or any of them and that free and clear and freely and clearly acquitted exonerated and discharged or otherwise by the said Robert Wood his Heirs Executors or Administrators well and sufficiently saved defended kept harmless and indemnified of from and against all and all manner of former and other Gifts Grants Bargains Sales Leases Mortgages Annuities Jointures Dowers Right and Title of Dower Uses Trusts Wills Intails Statutes Merchant and of the Staple Recognizances Decrees Judgements Executions Extents Rents and Arrears of Rents Fines Post Fines Issues Amerciaments Forfeitures Reentries Cause and Causes of Forfeiture and Reentry Debts upon Record Titles Troubles Charges and Incumbrances whatsoever already had made done committed or suffered by him the said Robert Wood or at any Time or Times hereafter to be had made done committed or suffered by him the said Robert Wood or his Heirs or by any other Person or Persons lawfully Claiming or to Claim by from under or in Trust for him them or any of them or by with or through his or their Act Means Assent Consent Privity or Procurement (The Rents and Services which from Michaelmas now last Past shall grow due and Payable for and in respect of the said hereby granted and released Premises to the Chief Lord or Lords of the Fee or Fees of whom the said Premises and holden only excepted and foreprized) And further that he the said Robert Wood and his Heirs and all and every other Person and Persons now having or lawfully Claiming to have or who shall or may at any Time or Times hereafter have or lawfully Claim to have any Estate Right Title or Interest of in to or out of the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereby granted released and conveyed or mentioned and intended so to be or any Part or Parcel thereof by from under or In Trust for the said Robert Wood or his Heirs shall and will from Time to Time and at all Times hereafter upon every reasonable Request and at the proper Costs and Charges in the Law of the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee make do acknowledge levy suffer and execute or cause or Procure to be made done acknowledged levied suffered and executed all and every such further and other lawful and reasonable Act and Acts Deed and Deeds Thing and Things Devices Conveyances and Assurances in the Law whatsoever which shall or may be for the further better more perfect and absolute assuring suremaking granting releasing conveying and confirming of the said Messuage or Tenement Garden Orchard Land Hereditaments and Premises hereby granted released and conveyed or intended so to be with their Appurtenances unto and to the Use and Behoof of the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee forever As by the said Joseph Ashbee and Henry Coulter and the Heirs and Assigns of the said Joseph Ashbee or his or their Counsel learned in the Law shall be reasonably devised or advised and required So as such further Conveyances and Assurances so to be made as aforesaid do not contain in them or any of them any further or other Warranty or Covenants than against the Parties thereto respectively and their respective Heirs and so as for the making doing executing compleating or perfecting thereof the Party or Parties who shall be required to make do execute or perfect the same be not compelled or compellable to go or travel from his her or their Habitation or Place of Abode In Witness whereof the said Parties to these Presents have hereunto Sett and Affixed their Hands and Seals the Day and Year first above written.
